Points-Based System Advice

UK Skilled Worker Visa Lawyers: Legal Requirements & Guidance

The UK Skilled Worker visa is the cornerstone of economic migration to the United Kingdom, allowing overseas professionals to take up employment with an approved A-rated sponsor.

To qualify, applicants must score a minimum of 70 points under the Points-Based System. Scoring points is divided into 50 mandatory points and 20 tradeable points.

Mandatory Points Structure (50 Points):
  • Sponsorship (20 points): Valid Certificate of Sponsorship (CoS) from a licensed UK employer.
  • Job at appropriate skill level (20 points): Job must be eligible at RQF Level 3 or above under eligible SOC code lists.
  • English language proficiency (10 points): Demonstrating CEFR Level B1 in reading, writing, speaking, and listening.

Tradeable Points (20 Points) & Salary Rules

The remaining 20 points must be earned through meeting the salary requirements. An applicant must generally be paid at least the general salary threshold and the 'going rate' for the specific occupation code, whichever is higher.

Tradeable options exist where the salary may be lower if the applicant qualifies as a 'new entrant' (e.g. switching from a Student or Graduate visa, or under 26 years of age), holds a relevant STEM PhD, or if the role is on an Immigration Salary List.

Switching into the Skilled Worker Route In-Country

Many applicants switch into the Skilled Worker visa from within the UK. Common switching categories include:

  • Student Visa holders: May switch once they have completed their course of study or if applying within specified degree timelines.
  • Graduate Visa holders: Can transition to Skilled Worker status before their 2-year (or 3-year PhD) Graduate visa expires, benefiting from 'new entrant' rate salary discounts for up to 3 years.
  • Youth Mobility or Dependent Visa holders: Permitted to switch into sponsored employment without departing the UK.

Path to Settlement (Indefinite Leave to Remain)

After completing 5 continuous years in the UK on a Skilled Worker visa (or combined with other eligible routes like Global Talent or T2 Minister of Religion), the visa holder may apply for Indefinite Leave to Remain (ILR).

Key settlement conditions include meeting continuous residence rules (no more than 180 days absence in any 12-month rolling period), confirmation from the sponsoring employer that the worker is still required and earns at or above the ILR going rate, passing the Life in the UK test, and meeting English language requirements.

Common Skilled Worker Refusal Reasons

Home Office caseworkers scrutinize applications closely for:

  • Genuineness of Vacancy: Suspicions that the role has been created solely to facilitate a visa, or that the duties do not match the assigned SOC code.
  • CoS Errors: Mismatched salary calculations, wrong working hours declared on the CoS, or failure to calculate pro-rata salaries based on standard 37.5-hour weeks.
  • Cooling-off & Overstaying: Unresolved gaps in lawful status or breaching visa conditions on prior permissions.
